Bush has been able to illegally wiretap anyone for any reason for the last 10 months, he doesn’t currently have to go to the FISA court. THis happened last year when congress passed what was supposed to be a temporary pass on FISA because there was some imminent terrorist threat on DC.

This FISA bill that Feingold and others are trying to stop because of telecom immunity actually puts the FISA court back in place. The legislation is bad, he’s not defending it, but it does restore the 4th amendment. So immunity is bad - but without this bill Bush can continue to spy on anyone for any reason without going to a court.
